Intellectual Property & Trademarks

The names, marks, compositions, and content that make Branch & Vow what it is — and how they may, and may not, be used.

1. Ownership

All content, design, source code, compositions, layouts, illustrations, typography selections, color systems, photography, written copy, and site architecture appearing on branchandvow.com (the “Site”) and within any Branch & Vow product, deliverable, or communication (collectively, the “Materials”) are the exclusive property of Branch & Vow (“we,” “us,” “our”) or are used under license from their respective owners. The Materials are protected by United States and international copyright, trademark, trade dress, design right, database right, and other intellectual property laws.

2. Trademarks

“Branch & Vow,” the Branch & Vow monogram, the Branch & Vow wordmark, the tagline “Rooted in Heritage · Celebrated in Love,” and the names of our signature compositions — including but not limited to The Vow Tree, The Twin Branch, and The Heritage Root — together with all related logos, marks, taglines, product names, and visual identifiers (collectively, the “Marks”) are trademarks and/or trade dress of Branch & Vow, whether registered or unregistered.

Nothing on the Site or in any Materials grants, by implication, estoppel, or otherwise, any license or right to use any Mark without our prior written permission. All goodwill arising from use of the Marks inures solely to Branch & Vow.

3. Copyright in Compositions

Each Branch & Vow lineage composition is an original creative work. Copyright in the underlying composition system — including the arrangement of generations, the typographic treatment, the ornamental marks, the botanical motifs, the inscriptional language, the layout grids, and the overall visual presentation — is owned by Branch & Vow. Personalization of a piece with family names, dates, and places does not transfer ownership of the composition itself.

Clients receive a personal, non-exclusive, non-transferable license to display, reproduce for private family use, and pass to heirs the specific personalized piece commissioned. Commercial reproduction, resale, derivative works, and use of the composition system for any third-party offering are reserved.

4. Trade Dress & Design Rights

The overall look and feel of the Site and of our printed and framed pieces — including paper stocks, frame profiles, color palettes, envelope treatments, and presentation — constitute protectable trade dress of Branch & Vow. Imitation of this trade dress in a manner likely to cause confusion as to source, sponsorship, or affiliation is prohibited.

5. Permitted Use

You may view, download, and print pages from the Site solely for your own personal, non-commercial use, provided that you do not modify the Materials, remove any copyright, trademark, or other proprietary notices, and do not republish, redistribute, or use the Materials for any commercial purpose.

Editorial press references to “Branch & Vow” in news reporting, reviews, and commentary are welcome, provided the Marks are used accurately and not in a manner that implies endorsement or affiliation. High-resolution press assets are available on request.

6. Prohibited Use

Reproducing, scraping, mirroring, or framing the Site or Materials, in whole or in part.
Using the Marks, or any confusingly similar mark, in your own branding, products, services, domain names, social handles, or advertising.
Training, fine-tuning, or evaluating machine-learning models, including generative AI systems, on the Materials without our prior written consent.
Reverse engineering, decompiling, or otherwise attempting to derive the source of any composition, template, or proprietary process.
Selling, sublicensing, or distributing personalized pieces to any third party.

7. User Submissions

When you submit names, dates, places, photographs, family histories, or other content (“Submissions”) to Branch & Vow for the purpose of commissioning a piece, you represent that you have the right to do so and you grant Branch & Vow a limited, non-exclusive, royalty-free license to use the Submissions solely to produce, deliver, and support your commissioned piece. We do not claim ownership of your family information.

8. DMCA & Infringement Notices

We respect the intellectual property of others and expect the same in return. If you believe that material on the Site infringes a copyright or trademark you own, please send a written notice to the address below containing: (a) identification of the protected work; (b) the location of the allegedly infringing material; (c) your contact information; (d) a statement made under penalty of perjury that the information is accurate and that you are authorized to act; and (e) your physical or electronic signature.

9. Reservation of Rights

All rights not expressly granted in this notice are reserved by Branch & Vow. Any unauthorized use of the Materials or the Marks may violate copyright, trademark, and other laws and may result in civil or criminal penalties.
